Outdoor Community Events Policy

!!! Conditions and Advisements Concerning COVID-19 and Phased Reopening Plans!!!!

The City of Helena may issue permits for events that could involve attendance of more than 50 people in circumstances that readily allow for appropriate physical distancing. It is the responsibility of the permittee/applicant to comply with State and local guidelines for group size and social distancing. Event organizers will likely have to limit the number of people in attendance based on the type of event and size of the event location.

Event permittees/applicants should familiarize themselves with the guidance provided by the Lewis and Clark Public Health Department concerning current Phase II COVID-19 reopening:

Violations of a public health order may be prosecuted by the Lewis and Clark County Attorney under 50-1-103 Montana Code Annotated (MCA).

1. Outdoor community events requiring temporary closures of rights-of-way must have the written approval of the City Manager for the closure prior to the event.Temporary right-of-way closures may be granted at the discretion of the City Manager after considering safety, traffic disruption, availability of alternate traffic routes, and other impacts of the closures.  Other outdoor events using parks and City-owned property are subject to the City Manager's approval.The City Manager shall report to the Commission all requests for closures and park uses that have been denied.

2. All producers or organizers of community events shall provide a damage and cleaning deposits for their particular event.

Deposits will be collected by the City entity having jurisdiction for the event and will be held until the event is over and damage or loss can be determined.  A list of deposits is shown below:

a.  Residential Block Parties (City residents requesting temporary
closure of right-of-way adjacent to their places of residence for
the purpose of neighborhood party or gathering).

b.  Damage deposit for consumption of alcohol on public right of way (as part of either residential or non-residential street closure requests).

c.  Parks (group use, reservation requested )

d.  Indoor park facilities

$250.00

3. Consumption of alcoholic beverages upon the public ways, streets, alleys, parks, and other places owned by the City is permitted only upon compliance with 4-2-11 of the Helena City Code. All deposits in that section are in addition to other deposits this policy may require.

4. Expenses incurred by the City as the result of an event will be reimbursed according to the following schedule:

a. Any overtime costs incurred by the Streets and Traffic Division and the Parks and Recreation Department must be reimbursed to them.  Overtime estimates can be obtained from the City prior to an event.   Fees based upon the estimates will be collected by the City entity having jurisdiction prior to the event.  Any overpayment will be returned to the event organizers or producers.  In the event that the Streets and Traffic Division or the Parks and Recreation Department are called out, a three (3) hour minimum will be charged.

b. A three (3) hour minimum will be charged if police officers are used for an event. Current rate is $60/hour per officer.  Contracts for police service must be completed by contacting HPD at 406-447-8479.

5. Park  fees set by Resolution 11089 are as follows:

a.  Bleacher rental fee
$200.00/unit/day

b.  Bleacher damage deposit ( to be returned
if no damage occurs to a unit)
$750.00

c.  Picnic table rental fee
$10.00/table

If requests for tables are made more than seven (7) days in advance, Parks and Recreation personnel will move the tables in and out.  If requests are made less than seven (7) days in advance, the event organizer must move the tables in and Parks and Recreation personnel will move them out.
